What is the difference between murder and homicide?
Homicide is when one person kills another, while murder is homicide with intent (pre-planned). Murder is not defined by common law, rather it is defined by statute. However, homicide has quite a different connotation and results in different legal ramifications, sometimes none at all.
While the terms murder and homicide may be interchanged frequently, they certainly have very different definitions in the eyes of the law. The different variations of these crimes may all depend on the morality, cause, and execution of the act, all of which are usually decided upon by a jury.

There is a big difference in US law or premeditated murder, and murder/homicide which is not premeditated but be can done impulsively or in a rage. In the US, the terms murder and homicide are interchangeable. And both can be accidental.

jonbroberts, People who win an NGI (Not Guilty by reason of Insanity) finding typically spend most of their remaining years in locked environments, not walking free. Winning NGI is not a walk in the park, either, it is an affirmative defense which requires the defendant PROVE they were insane at the time of the crime. Most people do not win on this--they can still be found guilty. Also, they are not ultimately declared "sane." They can be found to no longer require a locked, highly supervised environment. Typically what then happens is that these people are stepped down into more open, but still supervised settings. But many never leave a forensic hospital environment.
