The ostrich can run at speeds of up to 45 mph if necessary. This flightless bird is either one or two species of large flightless birds native to Africa, the only living member(s) of the genus Struthio, which is in the ratite family. Starting in 2014, the Somali ostrich is now considered a full species separate from the common ostrich.

It is not incorrect. A land (terrestrial) bird is a clearly defined term and Falcons are not land birds. A land bird forages and nests primarily on the ground and runs when threatened vs flies.

The question was not how fast can a bird run. It was what is the fastest land bird.The falcon does live on land. Ergo, it is the fastest.

The question is specific and asked for the fastest land bird. Land, or flightless, birds are birds that have no ability to fly, probably due to evolutional changes. There are over 60 extant species including ostriches, emus, chickens, penguins etc., and most still have residual wings.
If the questionner wanted to know the fastest flying bird, he would not need to mention land as most birds live on land. Just for information, the fastest bird is the Peregrin Falcon.
